A High Court sitting in Makurdi today struck out the case of certificate forgery and perjury instituted by Hon. Ademu Entonu, the defeated People’s Democratic Party (PDP) candidate in the just concluded National Assembly elections for Apa/Agatu Federal Constituency against Hon. Godday Odagboyi Samuel, the winner of the election on Labour Party platform.
The case was mentioned in court on the 18th of July, 2019 and slated for hearing on the 26th of September, 2019.
At the hearing on the 26th September, S.V. Akure, counsel to Hon. Ademu Entonu, pleaded for withdrawal of the case, opting for out of court settlement.
In his response, counsel to Hon. Godday Samuel, Barr. Amaatini Timothy objected to the the plea for withdrawal, noting that he was just served the notice few hours to court sitting hence the need for more time to study the withdrawal notice.
Barr. Timothy also reminded the court of his preliminary objections raised when the case first mentioned in court challenging the court’s jurisdiction to hear the case, and his prayers that the case be struck out for lack of merit.
Justice Kpochi thereafter adjourned the case till today, 4th October, 2019.
Delivering judgement today, the court struck out Ademu Entonu’s case for lack of merit and the motion for withdrawal by the Ademu Entonu’s counsel.
